DOT/FMCSA RIN: 2126-AC55 Publication ID: Fall 2022
Title: Emergency Egress Requirements for Buses; Amendments to Determination of Seating Capacity and Designated Seating Positions
Abstract: This rulemaking would propose to amend the emergency exit requirements for buses by updating the method for determining seating capacity and "designated seating positions" (DSPs) for buses, regardless of the date of manufacture, to closely align with the method and definition the National Highway Traffic Safety Administration (NHTSA) adopted for vehicles manufactured after September 1, 2010. FMCSA must identify the number of DSPs in order to determine the required location, type, size, and number of emergency exits required under 49 CFR 393.62, which incorporates by reference Federal Motor Vehicle Safety Standard (FMVSS) No. 217 (49 CFR 571.217). The rule would also propose conforming amendments to other related parts, including parts 387, 390, and potentially 383.
