Title: Unlicensed National Information Infrastructure (U-NII) Devices in the 5 GHz Band (ET Docket No. 13-49) | |
Abstract:
In the Notice of Proposed Rulemaking (NPRM), the Commission proposed to amend part 15 of its rules governing the operation of Unlicensed National Information Infrastructure (U-NII) devices in the 5 GHz band. U-NII devices are unlicensed intentional radiators that operate in the frequency bands 5.15-5.35 GHz and 5.47-5.825 GHz, and which use wideband digital modulation techniques to provide a wide array of high data rate mobile and fixed communications for individuals, businesses, and institutions. Since the Commission first made available spectrum in the 5 GHz band for U-NII in 1997, it has gained much experience with these devices. The Commission believes that the time is now right to revisit the part 15 rules, and, in the NPRM, proposes to modify certain technical requirements for U-NII devices to ensure that these devices do not cause harmful interference and thus can continue to operate in the 5 GHz band and make broadband technologies available for consumers and businesses. The Commission also sought comment on making available an additional 195 megahertz of spectrum in the 5.35-5.47 GHz and 5.85-5.925 GHz bands for U-NII use. This could increase the spectrum available to unlicensed devices in the 5 GHz band by approximately 35 percent and would represent a significant increase in the spectrum available for unlicensed devices across the overall radio spectrum. The initiation of this proceeding satisfies the requirements of section 6406(a) of the "Middle Class Tax Relief and Job Creation Act of 2012," which requires the Commission to begin a proceeding to modify part 15 of title 47, Code of Federal Regulations, to allow unlicensed U-NII devices to operate in the 5350-5470 MHz band. The Commission believes that an increase in capacity gained from 195 megahertz of additional spectrum, combined with the ease of deployment and operational flexibility provided by its U-NII rules would continue to foster the development of new and innovative unlicensed devices, and increase wireless broadband access and investment. The First Report and Order amends the Commission rules governing the operation of unlicensed National Information Infrastructure (U-NII) devices in the 5 GHz band to make broadband technologies more widely available for consumers and businesses by increasing power and permitting outdoor use in the U-NII-1 band and by adding 25 megahertz to the U-NII-3 band; it also takes steps to reduce the potential for harmful interference to incumbent operations. The proceeding satisfies the requirements of the Spectrum Act, by which Congress required that the Commission begin a proceeding regarding U-NII devices in the 5 GHz band within a year if it determined, after consultation with NTIA, that incumbents will be protected and their missions will not be compromised. In an Order, the Commission waived until December 2, 2015 the requirement in section 15.37(h) of the Commission’s rules that certain National Information Infrastructure (U-NII) devices must comply with the revised section 15.407 rules to be certified on and after June 2, 2015. This action is taken in response to a request by a group of interested parties (Joint Petitioners) to extend this compliance deadline as part of a larger review of the transition provisions we recently adopted for the U-NII-3 band. This action is being taken without prejudice relative to the merits of the Joint Petitioners’ filings in the docket. In the Memorandum Opinion & Order, the Commission addresses seven petitions for reconsideration of the First Report and Order (First R&O) in this proceeding. Specifically, we modify our rules to provide a relaxation of the out-of-band emission (OOBE) limits for operation of U-NII-3 (5.725-5.85 GHz) band devices. |
