NASA is revising its policy and procedures for implementing the National Environmental Policy Act of 1969 (NEPA) and the Council on Environmental Quality (CEQ) Code of Federal Regulations (CFR). This proposed rule would amend procedures contained in NASA’s current regulation at 14 CFR 1216.3, Procedures for Implementing the National Environmental Policy Act. The revision is necessary to clarify and update the current regulation. In compliance with NASA’s current regulation, NASA reviews the regulation’s categorical exclusions at least every seven years to determine whether modifications, additions, or deletions are appropriate. In addition, NASA reviewed the entire regulation to determine whether modifications, additions, or deletions are appropriate. This proposed rule incorporates updates based on NASA’s review of its Categorical Exclusions (CatExs) and inputs from CEQ. The proposed revisions will streamline the NEPA process to better support NASA’s evolving mission.
