The Department proposed one substantive change to section 200.89(b), pertaining to requirements for prospective re-interviewing. We propose to modify the current requirement to only require independent prospective re-interviews within the first three full performance reporting periods following the effective date of major statutory or regulatory changes which directly impact child eligibility, and would clarify acceptable interviewers for annual prospective re-interviews.

Identifying and addressing child eligibility errors are particularly critical given the direct relationship between counts of eligible migratory children and State allocations. The proposed modifications seek to reduce burden for State educational agencies while maintaining the integrity of eligibility determinations.
