The OCC, FRB, FDIC, SEC, and CFTC issued a proposed rule to implement sections 203 and 204 of EGRRCPA. Pursuant to section 203 of EGRRCPA, OCC-supervised institutions with total consolidated assets of $10 billion or less generally are not banking entities within the scope of section 13 of the Bank Holding Company Act (BHCA), if their trading assets and trading liabilities do not exceed 5 percent of their total consolidated assets, and they are not controlled by a company that has total consolidated assets over $10 billion or total trading assets and trading liabilities that exceed 5 percent of total consolidated assets. In addition, section 204 of EGRRCPA revises the statutory provisions related to the naming of covered funds.
